CHARTER SERVICES TERMS AND CONDITIONS

 

Your booking is accepted subject to the following terms and conditions and by confirming your booking you accept that these terms and conditions apply.

 

  1. CONDITIONS OF QUOTATIONS

Quotations are valid for a period of 14 days from the date supplied.

All prices quoted are current at the time of quotation and subject to availability at time of booking. All quoted prices include GST.

L.C. Dyson’s Bus Services Pty Ltd incorporating Dysons and Cobb & Co (Dyson Group) reserves the right to pass on, without notice, any increases that may occur in any applicable airport charges, road tolls, entry fees or parking charges.

A quote does not reserve or guarantee any vehicles and will be subject to availability at the time of confirming a booking. Dyson Group will not accept tentative bookings.

 

  1. BOOKINGS

Customer bookings must be received in written form, via e-mail or over the phone.

A written confirmation of the booking will be sent via email.  Please ensure you check the confirmation documentation thoroughly and advise us immediately if any amendments are required.  If we do not receive any amendments, we will assume all details are correct and charges will apply as per this documentation.

 

  1. AMENDMENTS / DELAYS / EXTENSIONS

Any amendment to your booking after confirmation can only be accepted subject to availability. Dyson Group reserves the right to charge an amendment fee in respect of any change to your booking in addition to any other applicable charges in relation to the amendment.

We reserve the right to impose additional charges for cleaning the interior of any vehicle that is in our sole judgement left in an unsatisfactory manner either during or at the conclusion of a hire period. This also applies to wilful damage by passengers to either the interior or exterior of the vehicle.

Dyson Group may remove waiting vehicles from a hire pick up point due to passengers being overdue by time exceeding 10 minutes, with or without notification by the passenger group or representative of such a delay, at our discretion. Due to other operational commitments this may result in job cancellation (refer to cancellation / alterations fees).

You are responsible for any charges levied by suppliers in respect of extra time if your booking does not run to schedule. This includes any extra charges levied where you choose to extend the duration of your booking and include charges for flight and / or traffic delays.

When a service is suspended due to government announcement mandates Dyson Group reserve the right to charge up to 25% of the value of the booking for unrecoverable costs.

 

  1. CANCELLATIONS / ALTERATION FEES

If you cancel your booking, Dyson Group reserves the right to charge a cancellation fee as follows:

  • Bookings cancelled greater than 4 days prior to travel: up to 25% of the value of the booking.
  • Bookings cancelled between 4 days prior to travel and the day of travel, but not on the day of travel: up to 50%.
  • Bookings cancelled on the day of travel: up to 100% of the value of the booking.

Dyson Group may cancel the booking due to an event/s out of our control. If a booking is cancelled in accordance with this clause, Dyson Group will reimburse you any amounts paid, but will not be responsible for any losses incurred by you.

Please note: Notice of cancellation must be provided in writing.

 

  1. PAYMENT

Prepaid Customers – Full payment is due 7 days prior to departure.  Pro-forma invoices will be raised on request.

Payment can be made by Cheque, Bank Transfer, Mastercard, Visa and Amex.

Customers using CREDIT CARDS note and accept the following service fees.

These fees are effective August 2021 and are inclusive of GST.

               Amex              3.2% charge

               Mastercard    1.3% charge

               Visa                1.3% charge

 

Account Customers with Credit Terms - a Tax invoice will be raised and sent after the service has been provided. Terms are as stipulated on the confirmation documentation.

Credit Application forms are available on request, approval time is minimum 7 days and credit cannot be extended prior to application being fully processed and approved by our credit department.

Please note that payment conditions for day tours and extended tours may vary and details will be provided upon booking.

 

  1. CONDITION OF BOOKING

We do not guarantee to provide additions or amendments during hire period; any such variation will be considered only and subject to, time taken, legal driving hours, deviation from route, knowledge of the area by driver and the driver’s agreement in consultation with our Service Delivery staff. Our decision in such matters will be final.

Dyson Group reserves the right to enforce its legal obligation in compliance with the law in all aspects of our hire provision irrespective of customer requests, conduct, actions or other circumstances effecting the provision of this hire.

This includes, but is not limited to our right to:

  1. Smoking: Smoking is not permitted by law on any vehicle supplied by Dyson Group
  2. Refuse entry to bus / coach of persons under the influence of alcohol or drugs
  3. Food and beverage consumption – food and beverages are not to be consumed on any vehicle without prior approval. In such circumstances payment of a bond may be required to cover the risk of damage to the vehicle. Your responsibility for any damage is in accordance with these terms and conditions
  4. Vehicle Damage: you are responsible for any charge levied by a supplier in respect of any damage caused to a vehicle as a direct result of this booking. You will not be responsible for payment where damage was caused by the actions any Dyson Group employee. In all cases the driver any vehicle will have the discretion to stop the vehicle and disembark those passengers engaging in unacceptable or unruly behaviour
  5. Authorise our driver to act in the best interests of the passengers’ safety irrespective of consequences to the hire program
  6. Obey road speed restrictions irrespective of unscheduled delays in transit
  7. Stop to render assistance to others when judged in the public interest for safety or rescue
  8. Report to authorities any person acting in a manner that endangers others, this could include our stopping a hire program or may result in its cancellation
  9. Refuse to carry dangerous, flammable or illegal items/goods on any part of a passenger/ person or the vehicle
  10. Determine the suitability and nature of any luggage or items intended to be carried by, or for, passengers on or within the vehicle cabin or storage areas and to refuse such items deemed as unacceptable. We take no responsibility for luggage lost or damaged whilst being handled, on tour or any time in transit; all items carried are at the owner’s risk
  11. Render first aid in the best interest of passengers and take such measures deemed necessary to enlist assistance in an emergency from any available services. Costs of such emergency service provision rest with the passenger/s
  12. Maintain legal driving hours and driver rest periods in line with current regulations
  13. Any issues arising from the hire and operation of our service must be received in writing within 30 days of the hire completion date, for an official response. Hire issues or compensation claims made after this time may not receive a response

 

  1. LIABILITY

Dyson Group has no liability for an act, omission or default, whether negligent or otherwise or any supplier. We have no liability for any loss or damage occasioned by the negligence, act or omission of any supplier or other third party. In circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements.

By placing the booking with Dyson Group, you acknowledge that you have read and are fully aware of our Terms and Conditions and agree to be bound by them.
